§ Right of Withdrawal (Cancellation Policy)
(1) Right of Withdrawal
If the customer is a business as defined by Section 1 of the Austrian Commercial Code (UGB), the right of withdrawal is completely excluded. Consumers have a statutory right of withdrawal. The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods. For digital content not supplied on a tangible medium, the period begins upon conclusion of the contract, but only if you have expressly agreed that we may begin performance before the end of the withdrawal period and you have been informed of the loss of the right of withdrawal.
(2) Withdrawal Procedure
To exercise your right of withdrawal, you must inform us (Elektrik Store – Dragan Kukrkic, Neustiftgasse 66/3/15, 1070 Vienna, Austria, Email: office@elektrikstore.at, Fax: +43 1 957 5781) of your decision by means of a clear statement (for example, a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.
(3) Consequences of Withdrawal
If you withdraw effectively, we must refund all payments received from you without undue delay and at the latest within 14 days from the day we receive your withdrawal notice. This refund includes the delivery costs of the standard shipment (but not the extra costs resulting from choosing a more expensive shipping option than the standard one). We will carry out the refund using the same means of payment that you used for the original transaction, unless you have expressly agreed otherwise.
You must bear the direct cost of returning the goods. We are not liable for any decrease in the value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
(4) Diminished Value
You are only required to compensate for any diminished value of the goods if that loss in value is due to handling beyond what is necessary to inspect their condition, properties, and functioning (for example, use of the goods beyond what would be allowed during a trial).
(5) Partial Withdrawal
In the case of a partial withdrawal from the contract, any discounts and shipping costs will be recalculated proportionately. Any difference to your advantage will be refunded; any difference to our advantage will be deducted from the refund amount.
(6) Exclusions
The right of withdrawal does not apply to:

Digital content once you have started downloading or streaming it and you have expressly agreed that we may start performance before the end of the withdrawal period and confirmed that you thereby lose your right of withdrawal.

Goods that have been made to customer specifications or that are clearly personalized.
Businesses have no right of withdrawal.
Right of Withdrawal for Safety-Critical Electrotechnical Components
For certain electrotechnical protection products, the statutory right of withdrawal may be excluded pursuant to § 18 para 1 item 5 FAGG (Distance and Off-Premises Contracts Act) if the seal has been broken or the safety packaging has been opened. These products are subject to strict safety regulations (e.g. ÖVE/ÖNORM E 8015-1), and returns are therefore only possible in an unopened, undamaged, and original condition.
This applies in particular to the following safety-critical components:

RCDs (residual current devices)

LS circuit breakers (line protection switches)

Surge protection devices (SPDs Type 1–3)

NH/HH fuse inserts

Power and motor protection switches

Fuses with condition indicators

Sockets and switches with integrated protection functions

Electronic protection and monitoring relays
-
EMC/network filters with protective function
-
Surge arresters for photovoltaic systems
-
Network and telecommunications surge protection (e.g. RJ45/CAT6 devices)
-
Pre-assembled distribution units with tamper-proof seals
-
Measuring and testing devices with calibration or safety seals
-
Arc fault detection devices (AFDDs)
-
Energy meters with integrity protection
-
Industrial connectors with integrated surge protection
-
Charging components for e-mobility with diagnostic or protective functions
-
Pre-assembled protection modules (e.g. SPD cable assemblies)
A return is only possible if:
-
the original packaging is unopened and undamaged,
-
there are no signs of installation or use (e.g. intact mounting screws, untouched contact surfaces),
-
all safety-relevant indicators (e.g. SPD status indicators) are intact.
In case of return of damaged or opened components, we reserve the right to reject the withdrawal in accordance with applicable legal provisions.
Installation Notice:
The installation, commissioning, and testing of the aforementioned safety-relevant electrotechnical components may only be carried out by licensed electrical contractors in accordance with the Austrian Electrotechnical Act (ETG 1992). Unauthorized or improper installation by unqualified persons can pose serious risks to health and safety and will void all warranty and liability claims.
